In surrogacy, a woman (surrogate) agrees to carry a pregnancy for another person or couple or intended parents, who become the legal parents after the child’s birth. In surrogacy, an embryo is created through IVF using eggs and sperm from the intended parents or donors. The surrogate mother is not biologically related to the child.
Surrogacy is assisted reproductive technology, which is suggested when the individual female or the couple can’t have children of their own, due to any medical reason, like the absence of a uterus in the female, has a health condition that makes pregnancy dangerous, or a woman has undergone cancer treatments that can cause infertility. Or when a male same sex couple wants to have a child of their own.
As per India’s ART law, a surrogate mother must be a close relative of the intended parents, must be married, have at least one biological child, and be between 25 and 35 years old. She also needs to obtain a certificate from a registered practitioner proving she is medically and psychologically fit for surrogacy. A woman can only serve as a surrogate mother once in her lifetime and cannot use her own gametes.
The estimated cost of surrogacy in Kolkata is between INR 15,00,000 to INR 25,00,000. This price includes the IVF treatment cost, a surrogacy fee for the surrogate mother, agency fees, and legal charges. As per Indian law, commercial surrogacy is illegal and punishable by law. Surrogacy success rates are high, often between 75% to 90%, depending on the clinic and individual case.
Indian law only permits altruistic surrogacy, which means commercial surrogacy is illegal and punishable. The intending couple must be indian citizens, married for at least five years, and have a medical certificate of proven infertility. The surrogate must be a close relative, between 25 and 35 years old, married, and already have at least one child of her own. The couple must also meet specific age requirements (woman 23-50, man 26-55) and provide mandatory insurance for the surrogate for a period of 36 months post-delivery. Finally, before starting the process, the couple must obtain a Magistrate's court order for parentage and custody of the surrogate child.
